The waiting period is not a preparation period: during that period all the obligations operate in full. The difference lies in one thing only - official announcements may not be received.

The Basic Rule - Art. 16/1

A newspaper or internet news site made subject to a waiting period in order to acquire the right to publish official announcements may not publish official announcements before that period expires. Otherwise the sanctions governed in Law No. 195 are applied.

The Obligations Operate in Full - Art. 16/2

Newspapers within the waiting period must be published in a way conforming to the interval of publication stated in the declaration filed under Law No. 5187, and internet news sites in a way fulfilling the requirements relating to the provision of access determined in this Regulation; and newspapers and internet news sites must have all the other qualities required and fulfil the duties imposed.

The Obligations Operating During the Waiting Period

  • The obligation to have a workplace (Art. 29)
  • Accounting - on the balance sheet basis (Art. 28)

  • Continuity of publication (Arts. 34, 56)
  • The sectoral books (Art. 37)

One Concession - Art. 16/3

However, in respect of newspapers or internet news sites within the waiting period, the provision of the first paragraph of Article 113 is applied taking as a basis the date of the start of the waiting period instead of the calendar year.

Official Advertisements May Be Received

Art. 10/2: newspapers and internet news sites holding the right to publish official announcements, or within the waiting period in order to acquire that right, also hold the right to publish official advertisements.

A Checklist

  • Is it published in conformity with the interval of publication in the declaration?
  • Is the staff complete and are the notifications made within 3 working days?
  • Are the copies uploaded to ILANBIS by 09.00 on the day of publication?
  • Is the imprint complete?
  • Are the workplace conditions met? (at least 5 m² per person, a sign, technical equipment)
  • Are the accounts kept on the balance sheet basis?
  • Are you sure no official announcement has been published?

Summary

Newspapers and internet news sites in the waiting period may not publish official announcements; otherwise the sanctions in Law No. 195 are applied. In return they must, throughout that period, be published in conformity with the interval of publication in the declaration, have all the qualities required and fulfil the duties imposed. The measure of a calendar year in Art. 113/1 is applied to them taking as a basis the date of the start of the waiting period.
